Website terms

1. Who these terms are with

This website is operated by TLK ("we", "us"). By using the site you agree to these terms. If you do not agree, do not use the site.

Other terms also apply to what you do on the site: the Directory Terms when you claim or manage a business page, the Business Profile Terms when you buy a Business Profile, the buyer terms when you take part as a buyer, and the supplier terms when you take part in meetings as a supplier. Where those terms conflict with these, those terms prevail for that activity.

2. What this site is

TLK is a directory of Australian businesses. Every active business is listed from public register data. A business can claim its page for free, and can buy a Business Profile to show more detail and take enquiries from buyers. Businesses with a Business Profile can also meet buyers who are reviewing what they sell: buyers tell us what they are reviewing, and we book short online meetings with suppliers they choose.

3. Your account

3.1 You must give accurate information when you create an account, and keep it up to date.

3.2 Accounts are for a business, and for the people at that business you authorise. You are responsible for what is done through your account.

3.3 We sign you in with a link sent to your email address. Keep access to that address secure, and tell us promptly if you think someone else has access to your account.

3.4 We may suspend or close an account that is used in breach of these terms.

4. Acceptable use

You must not:

  • use the site for anything unlawful, or to send anything unlawful, misleading or harmful;
  • scrape, harvest or bulk-extract data from the site, or use automated means to access it beyond ordinary browsing;
  • try to gain access to any part of the site, account or system you are not authorised to use;
  • interfere with the site's operation or security, or test it without our written permission;
  • impersonate anyone, or misrepresent who you are or who you act for; or
  • use anything from the site to build a competing service.

5. Our intellectual property

5.1 The site, its design, text, images and software are owned by us or licensed to us, and are protected by copyright and other rights.

5.2 You may read the site and print or save pages for your own business use. Any other use, including copying, republishing or adapting material, needs our written permission.

5.3 "TLK", "TLK Source" and our logo are our marks. Do not use them without our written permission.

6. Who's buying, and the data behind it

6.1 The Who's buying tool draws on published Australian Bureau of Statistics data, including Counts of Australian Businesses and the Australian National Accounts input-output tables. ABS material is used under a Creative Commons Attribution licence and is attributed on the page.

6.2 The figures are estimates, published at a level of aggregation the ABS chose, and are not about any particular business. Industry groupings are broader than our category labels, and the page says so where that matters.

6.3 We give no warranty that the figures are accurate, current or fit for any purpose. Do not rely on them as the sole basis for a business decision.

7. Links to other sites

The site may link to sites we do not control. We do not endorse them and are not responsible for their content or their handling of your information.

8. Availability

We aim to keep the site available, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it.

9. Disclaimers

9.1 Information on the site is general in nature. It is not legal, financial, procurement or other professional advice.

9.2 We do not recommend suppliers, rank them, or take part in any agreement between a buyer and a supplier. This is not a formal procurement process.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If a guarantee applies and cannot be excluded, our liability for failing to meet it is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

10. Limitation of liability

10.1 Subject to the Australian Consumer Law section above, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, or loss of anticipated savings arising from use of the site.

10.2 Subject to that section, our total liability arising from your use of the site is limited to the amount you have paid us in the twelve months before the event giving rise to the liability, or one hundred dollars if you have paid us nothing.

11. Indemnity

You indemnify us against loss we suffer arising from your breach of these terms, your unlawful use of the site, or your infringement of another person's rights. This does not apply to the extent the loss was caused by us.

12. Privacy

How we handle personal information is set out in our privacy policy.

Changes to these terms

We may change these terms. If a change materially affects you, we will tell you by email or by a notice on the site before it takes effect. The version published here is the one that applies. Continuing to use TLK after a change takes effect means you accept the changed terms.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
