Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules governing your use of the TLK Source Freight Audit & Recovery Kit service, the TLK Source website (tlksource.com.au), the client portal, and our AI assistant Alex (collectively, the "Platform"). This AUP forms part of our Terms and Conditions.

2. Permitted use

You may use the Platform to:

  1. Upload your freight invoices, rate cards, and manifests for the purpose of obtaining a Freight Audit & Recovery Kit;
  2. Access and download your Deliverables;
  3. Communicate with TLK Source via email or the AI assistant Alex for service-related enquiries.

3. Prohibited use

You must not:

  1. Use the Platform for any unlawful purpose or in connection with any unlawful activity;
  2. Upload data to which you do not have the legal right, including data subject to confidentiality obligations that prevent its disclosure to TLK Source;
  3. Upload malicious files, viruses, malware, or any code designed to disrupt, damage, or gain unauthorised access to systems;
  4. Attempt to reverse-engineer, decompile, disassemble, or otherwise extract the source code, algorithms, or logic of TLK Source's proprietary analysis engine;
  5. Attempt to extract, reconstruct, or derive TLK Source's proprietary benchmark dataset;
  6. Use the Platform or Deliverables to build, train, or improve a competing service or product;
  7. Resell, sublicense, redistribute, or commercialise the Deliverables or any part of the Platform;
  8. Use the Deliverables to make public representations about any carrier without independent verification of findings;
  9. Impersonate any person, business, or entity, or misrepresent your affiliation with any person or entity;
  10. Submit fabricated, falsified, or materially misleading data;
  11. Interfere with or disrupt the integrity or performance of the Platform;
  12. Attempt to gain unauthorised access to any part of the Platform, other accounts, or systems connected to the Platform;
  13. Use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform without prior written consent;
  14. Use the Platform in a manner that could damage, disable, overburden, or impair TLK Source's infrastructure;
  15. Circumvent or attempt to circumvent any access controls, security measures, or usage limits.

4. AI assistant Alex

When interacting with Alex, our AI-powered assistant, you must:

  1. Not attempt to manipulate Alex into providing advice it is not designed to give, including legal, tax, or financial advice;
  2. Not use Alex to generate, store, or transmit any content that is unlawful, harassing, defamatory, or otherwise objectionable;
  3. Understand that Alex's responses are informational and do not constitute professional advice of any kind.

5. Consequences of breach

If TLK Source reasonably determines that you have breached this AUP, we may, at our discretion and without prior notice:

  1. Suspend or terminate your access to the Platform;
  2. Refuse to deliver or withhold Deliverables;
  3. Decline to provide a refund for any fees paid;
  4. Report unlawful activity to the relevant authorities;
  5. Pursue any other legal remedies available to us.

Where practicable, we will provide notice before taking action and give you an opportunity to remedy the breach.

6. Reporting abuse

If you become aware of any misuse of the Platform or a breach of this AUP by another user, please report it to hello@tlksource.com.au. We take all reports seriously and will investigate promptly.
